While you may be able to browse the Platform (Website and App collectively referred to as “Application”) from countries outside of India, however, please note we do not offer any product/service under this Application outside India. By visiting the Application or providing your information, you expressly agree to be bound by this Privacy Policy and agree to be governed by the laws of India including but not limited to the laws applicable to data protectiofn and privacy. If you do not agree please do not use or access our Application.
DEFINITIONS
The capitalized terms shall have the meaning as defined under: -

ii. Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to INAUCTION International Private Limited.
iii. Country refers to India.
iv. Device means any device that can access the service such as a computer, a cell phone or a digital tablet.

vi. Service Provider means any natural or legal person who processes the data on behalf of the Company. It includes third-party companies or individuals employed by the Company to facilitate the service, to provide the service on behalf of the Company, to perform services related to or to assist the Company in analysing how the service is used.
vii. Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
viii. Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
ix. You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

To avail our service, you are required to provide us certain information which is used to register you, verify your identity to permit you to use the app, undertake transactions (including to facilitate and process payments), communicate with you, convey any promotional offers, services or updates associated with INAUCTION, and generally maintain your accounts with us. However, in case you choose to decline to submit Personal data on the Application, we may not be able to provide certain services on the Application to you. We will make reasonable efforts to notify you of the same at the time of registration with us. In any case, we will not be liable and or responsible for the denial of certain services to you for lack of you providing the necessary personal information.

Usage Data is collected automatically when using the service. Usage Data may include information such as your Device's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our service that You visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

i. To provide and maintain our service, including for the purposes of opening your account, processing your transactions, responding to your requests, and communicating with you;
ii. To manage your registration as a user of the service. The Personal Data provided can give You access to different functionalities of the service that are available to You as a registered user;
iii. We use your personal information to take and handle orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers ;
iv. We use your personal information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of our Platform.

INFORMATION SHARING
We may share Your personal information with any third party without obtaining your prior consent in the following limited circumstances:
i. we may share Your personal information with Service Providers to monitor and analyse the use of our service however it is usually in the form of aggregated statistics on traffic to various pages within our site;
ii. The Service Providers we use may have access to your Personal Data to provide additional services as requested by you among other things. These third-party vendors collect, store, use, process and transfer information about Your activity on our service in accordance with their Privacy Policies. However, we endeavour that these recipients of such information agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures;
iii. Order processing - For instance using a third party order management system to track and document the orders you place with us.

x. when you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If you interact with other users or register through a Third-Party Social Media Service, your contacts on the Third-Party Social Media Service may see your name, profile, pictures and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with You and view your profile.
xi. The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
a. Protect and defend the rights or property of the Company
b. Prevent or investigate possible wrongdoing in connection with the service
c. Protect the personal safety of Users of the service or the public

ACCESSING AND UPDATING PERSONAL INFORMATION
When you register with us, we contact you from time to time about updating of your personal information to provide the users such features that we believe may benefit / interest you. Further when you use the services, we make good faith efforts to provide you, as and when requested by you, with access to your personal information and shall further ensure that any personal information or sensitive personal data or information fosund to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law or for legitimate business purposes. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

RETENTION OF INFORMATION
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. The Personal Data shall be retained for a period of one hundred and eighty days after any cancellation or withdrawal of the registration, as the case may be.
The Company will also retain Usage Data and information collected while using the Application for internal analysis purposes. Such information is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our service, or We are legally obligated to retain this data for longer time periods.

In terms of Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) 2021 as amended from time to time, the Grievance Officer shall resolve the matter within 15 days of the receipt of the Complaint or such shorter period as applicable.

4. A statement that you have a good-faith belief that the information has been processed incorrectly or disclosed without authorization, as the case may be
5. A statement, under penalty of perjury, that the information in the notice is accurate, and that the information being complained about belongs to you.
Any person aggrieved by a decision of the Grievance Officer may prefer an appeal to the Grievance Appellate Committee within a period of thirty days from the date of receipt of communication from the Grievance Officer.
DISCLAIMERS:
• We DO NOT solicit confidential details like your OTP/CVV/PIN/Card Number/ Bank account details through any means. We never calls users/customers with offers, discounts on products and offering free gifts.
• Scamsters/fraudsters attempt various techniques such as ‘phishing’, to contact, influence and defraud consumers. We regularly cautions its customers against sharing any personal or payment sensitive information with unknown persons as such sharing leads to unauthorized use and/or fraud and consequent financial loss.
• We shall not be liable for any loss, damage, or expense incurred by a Customer where the Customer has shared personal and/or payment sensitive information with scamsters/fraudsters.
• We also request and encourage our Customers to report such attempts or incidents to our Grievance officer (or Customer care) to enable us to investigate and explore legal recourse.
• We rely on payment partners and banks. In certain cases, involving payment/refund issues, we might see a delay as that is beyond our control once we pass the investigation to them however, we try our best not to exceed timelines stated in this policy/Terms
